01Agreement to these Terms
These Terms of Service ("Terms") form a legally binding agreement between you and MyTrustCredit Sdn Bhd (Company No. SSM 202301012345-D), a moneylender licensed by the Ministry of Housing and Local Government (KPKT) under Moneylenders Licence No. WL1234/5678 ("MyTrustCredit", "we", "our").
These Terms govern your use of mytrustcredit.com and of any pre-contract materials provided by MyTrustCredit. If we offer you a loan and you accept, the specific financial terms (principal, tenure, interest, fees, repayment schedule) will be set out in a separate Loan Agreement that supplements — and, where in conflict, prevails over — these Terms.
By accessing mytrustcredit.com, submitting a loan application, or signing a Loan Agreement, you confirm that you have read, understood, and accepted these Terms. If you do not accept them, you must stop using the Service.
02Nature of the Service — we are your direct lender
MyTrustCredit is a KPKT-licensed moneylender under the Moneylenders Act 1951. We are not a broker, introducer, comparison site, or lead-generation platform. We approve, fund, and service every loan ourselves using our own balance sheet.
When you apply and are approved, you enter into a Loan Agreement directly with MyTrustCredit Sdn Bhd. No other financial institution is a party to that agreement. All communications, disbursements, statements, and collection activity come from MyTrustCredit.
Whether a loan is approved, and on what terms, is at MyTrustCredit's sole underwriting discretion. As permitted under the Moneylenders Act 1951, we may decline an application without providing detailed reasons.
03Eligibility
You may only apply for a loan if, at the time of application, all of the following are true:
- You are at least 21 years of age and have full legal capacity to contract.
- You are a Malaysian citizen or a Permanent Resident (PR) of Malaysia.
- You hold a valid Malaysian identification card (MyKad).
- You have verifiable income — salaried, self-employed, or pension — in Malaysian Ringgit.
- You hold a valid Malaysian bank account in your own name, registered with DuitNow, to receive disbursements and make repayments.
- You are not currently the subject of bankruptcy proceedings.
- You do not have more than 3 active defaults recorded on CCRIS at the time of application.
04Acceptable use
You agree not to use mytrustcredit.com or our Service to:
- Submit false, misleading, or stolen personal information.
- Apply on behalf of another individual without their written authority.
- Circumvent security controls, scrape content, or probe our infrastructure.
- Use the proceeds of any loan for money laundering, terrorism financing, tax evasion, gambling, or any other unlawful activity.
- Upload viruses, malware, or any code designed to disrupt the Service.
- Harass, threaten, or use abusive language towards MyTrustCredit staff, collection agents, or any third party contacted in connection with your loan.
05Application, approval, disbursement & rates
The end-to-end flow from application to disbursement is as follows:
1. You submit the online application form at mytrustcredit.com. We do not require a password-protected account — each application is accessed via a secure, single-use magic link sent to your verified email and mobile number.
2. We underwrite your application in-house, including optional CTOS / CCRIS soft inquiries. We may request supporting documents (MyKad, salary slips, bank statements, employer verification).
3. If approved, we issue a Loan Agreement setting out the principal, tenure, interest rate, all fees, repayment schedule, and default consequences. Every fee and charge is disclosed in writing before you sign.
4. You review the Loan Agreement. You may accept, decline, or negotiate. There is no obligation to proceed.
5. On e-signature of the Loan Agreement, funds are disbursed to your registered Malaysian bank account, typically within 24 to 72 hours subject to bank cut-off times.
Our interest rates range from 4% to 18% per annum (flat), assessed at our underwriting discretion and always within the statutory cap of 18% for unsecured loans set out in the Moneylenders Act 1951. The applicable rate for your loan is set out in your Loan Agreement.
- Processing fee — Either 1%–2% of the principal or a flat fee of RM 50–RM 100, disclosed up front in your Loan Agreement. Never charged before disbursement.
- Stamp duty — 0.5% of the principal, or RM 10 for short-tenure loans, payable to the Inland Revenue Board under the Stamp Act 1949.
- Late payment fee — 1% per month on the overdue amount only — capped at statutory limits under the Moneylenders Act 1951.
- Early settlement fee — Up to 3 months' interest on the outstanding principal, calculated at the rate stated in your Loan Agreement.
06Repayment, default & general disclaimers
You agree to repay the loan strictly in accordance with the Loan Agreement, by the due dates stated, via the repayment method you authorised (auto-debit, DuitNow, or IBG). If a repayment fails or is missed, we escalate as follows:
Day 1 after miss — courtesy reminder by WhatsApp / SMS / email. Day 7 — formal reminder; late fee begins to accrue. Day 60 — the missed payment is reported to CCRIS as overdue. Day 90 — we may engage a licensed debt collection agency that has signed our Debt Collection Code of Conduct. Day 180 — we may commence civil proceedings in the Sessions Court of Malaysia to recover the outstanding balance, costs, and interest.
At every stage, you retain the right to contact us to restructure, settle, or dispute the debt. Our collection conduct is governed by the Moneylenders Act 1951, PDPA 2010, and our published anti-harassment policy.
Separately, mytrustcredit.com is provided on an "as is" and "as available" basis. We do not warrant that the website will be uninterrupted, error-free, or free from security vulnerabilities. Any loan amounts, rates, or cashback figures displayed outside a signed Loan Agreement are indicative only; your contractual terms are only those in the signed Loan Agreement.
07Limitation of liability
To the maximum extent permitted by Malaysian law, MyTrustCredit is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, goodwill, or data arising from your use of mytrustcredit.com.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any liability that cannot lawfully be excluded under Malaysian consumer-protection law.
Our aggregate liability for any claim arising out of or related to your use of mytrustcredit.com (and excluding performance of a signed Loan Agreement, which is governed by that agreement) is capped at the greater of (a) any fees you have paid to MyTrustCredit in the 12 months preceding the claim, or (b) MYR 500.
08Intellectual property
All content, trademarks, logos, illustrations, and software on mytrustcredit.com are the property of MyTrustCredit Sdn Bhd or its licensors, and are protected by the Copyright Act 1987, the Trademarks Act 2019, and international IP conventions. Except for personal, non-commercial browsing, you may not copy, modify, distribute, publish, or create derivative works without our prior written consent.
09Governing law
These Terms, and any Loan Agreement you enter into with us, are governed by, and construed in accordance with, the laws of Malaysia, without regard to its conflict-of-laws principles.
10Dispute resolution
If you have a complaint or dispute, please first contact our Complaints team under our published Complaints Procedure. We aim to resolve every matter internally.
If your complaint cannot be resolved within 30 days of internal escalation, the dispute (other than a regulatory complaint to KPKT, which is unaffected by this clause) shall be referred to and finally resolved by arbitration administered by the Asian International Arbitration Centre (AIAC) in accordance with its Arbitration Rules, seated in Kuala Lumpur, conducted in the English language, before a sole arbitrator. The seat of arbitration and the supervisory courts shall be the Malaysian courts at Kuala Lumpur.
Nothing in this clause prevents either party from applying to a court of competent jurisdiction in Malaysia for interim or injunctive relief, or for the enforcement of any arbitral award.
11General — severability, assignment & waiver
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be struck down only to the extent necessary, and the remainder of these Terms shall continue in full force and effect.
These Terms, together with any signed Loan Agreement and the documents expressly referenced therein, constitute the entire agreement between you and MyTrustCredit relating to their subject matter, and supersede all prior discussions, representations, and understandings.
We may assign these Terms, and any rights under a Loan Agreement, to a successor in business, a permitted affiliate, or a licensed debt purchaser. You may not assign or transfer your rights or obligations without our prior written consent.
Failure by MyTrustCredit to enforce any right under these Terms is not a waiver of that right, and a waiver in one instance does not apply to any subsequent breach.
